General terms and conditions for the use of E-charging stations

1)    Scope of application
These general terms and conditions (hereinafter GT&C), applying to the charging of electric vehicles  at the public charging stations of the Grossglockner Hochalpenstrassen AG [Grossglockner High Alpine Roads plc], are also available on the website.

2)    Tariffs, costs and payment
The Grossglockner Hochalpenstrassen AG is entitled to remuneration. The charging process begins when the charging cable is plugged in, and ends when the cable is correctly unplugged, or when the maximum storage capacity of the vehicle's battery is reached. The kWh supplied will be invoiced.
The current tariffs are gross prices, and will be displayed at the charging station.
By carrying out the charging process, the customer agrees to the current tariffs.

The tariffs displayed refer exclusively to the service of charging an electric vehicle. Fees for parking or waiting are not included in the tariffs.

Payment is made by debit or credit card directly at the charging station.

3)    Scope of services
Use of the E-charging stations in accordance with these GT&C is possible only at the E-charging stations of the Grossglockner Hochalpenstrassen AG. Depending on the location, access to the charging stations may be time-limited (e.g. due to opening hours of the access roads or the car parks, closure due to winter weather conditions or for safety reasons, etc.). A list of current locations can be found on the website. The location of a charging station and the number of chargepoints available may be changed for economic or technical reasons.
Specific availability of the charging stations is not guaranteed. Availability may be affected by e.g. maintenance work, technical faults, obstruction of access to the chargepoint or use by other customers. Use of the charging stations is subject to availability.
The maximum output available may on occasion be reduced, particularly when temperatures vary or when several electric vehicles are being charged at the same time. It may also be temporarily reduced for technical reasons, such as overheating of components in the charging system or if output limits are exceeded at upstream systems. Reduced output does not entitle customers to make any claims against the Grossglockner Hochalpenstrassen AG.

4)    Due diligence obligations of the customer
The customer must follow all the instructions displayed at the charging station. In addition, the following rules must be observed:
The customer chooses the chargepoint best suited to their electric vehicle. The vehicle must be correctly parked on the space intended for charging. The use of other chargepoints at the location must not be affected.
The charging station must be used in such a way that no damage is caused, neither are other people endangered. In particular, the customer must use an undamaged cable with suitable and safe plugs; cable and connection must be checked for any damage before starting the charging process. If any damage, such as cracks, kinks or exposed parts are detected, the charging cable may on no account be used.
The customer must ensure a safe connection between the vehicle and the charging station, and must park the vehicle so that the connection is as short and safe as possible; the cable must not hinder or endanger third parties.
Out of consideration for other customers, the charging station and the parking space must be vacated as quickly as possible after completion of the charging process. The maximum charging time and the fees incurred after exceeding the maximum charging time are shown on the payment terminal and/or on the website of the Grossglockner High Alpine Road.
The customer must at all times observe the current technical regulations regarding the vehicle, the charging cable and the electrotechnical safety regulations; in case of non-compliance, the customer shall be held liable. In addition, the customer is liable for any accidents and/or damages that fall within their area of responsibility, and must thus take all precautions to avoid accidents or damage.
Any faults, damage or misuse of the charging stations must be reported immediately to the Grossglockner Hochalpenstrassen AG (hotline tel: 0676/83616800).

5)    Liability and compensation
The choice of charging station with the suitable plug type and output for the vehicle  is up to the customer. The customer also bears the risk for parking the vehicle and for the charging process. The customer must treat the charging station with as much care as possible and must avoid damage or any kind of manipulation. Any unlawful use of the charging stations or damage to structures in connection with the charging station, to the charging station itself or to the user terminal shall be made good by the customer.
The Grossglockner Hochalpenstrassen AG will not be held liable for any damage caused by non-availability of charging stations, misuse by third parties or temporary output reduction.
Insofar as permitted by law, liability of the Grossglockner Hochalpenstrassen AG or any vicarious agent in their employ is restricted to intent and gross negligence. Liability for damage to property, loss of profit, consequential damages and all indirect damage is excluded to the extent permitted by law.

6)    Data protection
When the charging process is carried out, the customer's consumption and billing data are automatically transmitted to the Grossglockner Hochalpenstrassen AG. The billing and consumption data serve the legal obligations within the framework of accounting. The non-personal consumption data are used for evaluations of the utilisation and economic viability of the individual chargepoints.

7)    Jurisdiction and applicable law
For all disputes under civil law in connection with the paid use of the Grossglockner Hochalpenstrasse, the respective court with subject-matter jurisdiction at the place of the registered company GROHAG in the Town of Salzburg shall have jurisdiction in each case.
Austrian law shall apply exclusively; the "conflict of laws" rules of private international law shall be excluded.
